No Tax on Tips for Self-Employed and Gig Workers
Self-employed people can claim the tips deduction, with extra limits.
What are the self-employed limits?
- Your occupation must be on the IRS tipped-occupation list.
- The deduction can't exceed your net income from the business where you earned the tips (figured without this deduction).
- You can't claim it if your business is a specified service trade or business (SSTB) under § 199A.
- The $25,000 cap and $150,000/$300,000 phase-out still apply.
Do gig apps report my tips?
The law requires payors to report tips and occupation on information returns such as Form 1099-K or 1099-NEC (the IRS gave transition relief for 2025). Keep your own app earnings statements that separate tips from fares or delivery pay.
Do I still owe self-employment tax on tips?
Yes. The deduction lowers income tax only, not self-employment tax.
